Your grandfather's two sons, including your father, have passed away without leaving a will.In the absence of a will, the property distribution follows the rules of intestate succession based on the laws of the jurisdiction, specifically Tamil Nadu. The Hindu Succession Act, 1956, applies in Tamil Nadu, and it governs the division of the property among the legal heirs. In your case, your uncle's wife and son are the legal heirs of your uncle (the elder son of your grandfather), while your mother and yourself are the legal heirs of your father. Based on your statement, your mother, your brother (your uncle's son), and your aunt (your uncle's wife) have expressed their intention to gift the property to you.
