I would like your assistance in providing me Legal opinion on the trauma I underwent due to the Medical negligence post-meeting with Dentist Dr. Ashok for my root canal treatment.I had to lose one of my teeth (one tooth already extracted, other trying to save, will have to wait and see if I can save or have to lose both of my teeth), face severe pain and mental agony due to the negligence and maybe incompetency of the dentist Dr. V. Ashok. I had to make multiple visits to the dentist which also had put me to risk of getting corona infected.His negligence has caused me to lose my valuable tooth (one is already extracted and I am struggling to save the other tooth and exploring options), causing me unbearable tooth pain which I had to bear till now for the last 2 months, it has also caused me a lot of mental agony and depression. Below is the sequence of events, I have tried to capture all the conversations to the best of my knowledge

Root canal treatment

31 July - Went to visit Dr. Ashok because of tooth pain and he performed root canal treatment1 August - The doctor followed up on WhatsApp if there is any pain and also he requested to do a google review. And I was fine that day3 / 5th august - Went for the second sitting of the root canal, he performed the activity for an hour, he took measurement for the cap the same day, and from that day the pain started very badly. He said the cap for the tooth will be ready in 5 days and i need to come for another sitting13 August - He had called earlier and said the cap measurement did not come properly and asked to come and see, I told him there is still severe pain, he gave me medication and said it will subside, and it could be due to infection.Don't recall date - There was an in-between visit, where he took a scan within his premises and checked and gave medications.26 August - Dr. Ashok asked me to take a complete tooth scan from rkm dentoscan and I did a complete scan on that day and gave him the scan report, he saw the report and said the adjacent teeth also need a root canal and asked to come to the next day

27/28th August - Dr. Ashok performed a root canal for the second teeth and the pain started to increase from there on, I was given medications and was taking medications and hoping to see if the pain will subside, i waited for 10 days and the pain did not subside and decided to take the second opinion.10th September - Went to Apollo for a second opinion and there they said both the teeth have the instrument broken in it and in one tooth on top of the instrument being broken the root canal was performed wrongly and had been damaged from the center and it had to be extracted and for the other teeth they will try to remove the instrument but cannot guarantee as it can only be tried else it also has to be extracted. So I am left with the option of both tooth being extracted.They suggested going for dental implantation and the entire process would cost me more than a lakh as estimated, and it was sounding very expensive for me so I called another referred dentist Dr. Raj Vikram for an appointment the same day and went and met him.

pain and discomfort

Dr. Raj Vikram also say that one tooth is in very bad shape and has to extract for sure and the other tooth he will try and see if it can be saved. One of the teeth that were in bad shape and were causing a lot of pain and discomfort was extracted on the same day14 September - Dr. Raj Vikrams team performed a root canal on the tooth that Dr. Ashok did not complete properly and also performed a root canal on the upper tooth (this is another one)21 September - Reported to Dr. Raj Vikram that I am good with the tooth that the root canal was done by their team but the one that was attempted by Dr. Ashok the pain is still there, they tried to do the cleaning of the tooth and reduce its size to avoid any biting pain and left to see if it improves. But to date, the pain has not subsided in the tooth root canal attempted by Dr. Ashok. I am still hoping to save my other valuable tooth.
