I need your legal advice with regards to the outstanding dues on my credit card. I was working for BPO, lost my job due to the covid 19 pandemics in November 2020. Until July 2021 I paid all my credit card dues with my savings and PF. But after that, I faced financial difficulties so I tried to apply for \" loan Moratorium\"  under  RBI guidelines with my credit card provider \" Kotak Mahindra bank\".I faced multiple difficulties which I listed below.1. I called the Phone banking number to get details on \" how to apply for loan moratorium \". I was told \" loan moratorium is not allowed\".2. Still I tried to reach a higher official \"\"   by email \"   as this was approved by RBI. I got an email reply as a loan moratorium is not allowed.3. As my last attempt I sent a detailed request in the post to Kotak Mahindra bank office in Mumbai requesting them to approve loan moratorium at least for 12 months so I could find a job within that time frame and be in a position to clear my dues. But no reply was received. As no reply was received and unable to contact a higher official to ask for more details on \" why a loan moratorium can be approved \" I raised a complaint with banking ombudsman operated by RBI seeking help few days back and waiting for resolution as it may take anywhere between 4 to 8 weeks. Now I received \" legal notice \" from kotak mahindra bank advising me to clear dues of Rs. 31168.02 with in 24 hours. This I feel both threatened and cheated because of below reasons.1. RBI guides lines on Loan moratorium for 2021 applies to all banks and Kotak mahindra bank accepts the same which is shown in the document which I attached below and this document I downloaded from kotak mahindra bank website.2. Kotak mahindra bank did not provide a \" option \"  itself to apply for a loan moratorium either as a paper form or a weblink which is again not a good thing and this is against RBI guidelines.3. On all forms of communication including phone, email, webchat their official stance on the loan moratorium was \" not allowed\" and this is completely unacceptable since this was approved by RBI and most other banks provided the same.4. The complaint I raised with banking ombudsman is till in review as it was applied only few days back. With out waiting for an outcome bank sent me a legal notice which I feel is \" threatening and unacceptable\".5. Upon researching more I found this kind of things is not new to this bank. The reason was Kotak AMC which is part of this bank and manages Mutual funds was fined by SEBI for not \" following\"  certain rules. Popular Questionshttp://103.133.215.241/lawyerchennai/legal-consultation/legal-notice-checking/http://103.133.215.241/lawyerchennai/legal-consultation/nighttime-construction-despite-orders-to-stop-from-cm-cell/http://103.133.215.241/lawyerchennai/legal-consultation/high-court-petition/
